Anti-Money Laundering (AML) & Know Your Customer (KYC) Policy

Mandatory Checks and Due Diligence – Keeping Everyone Safe

1. Introduction

If you are buying, selling, renting or letting a property in England, Property Hub Ltd is legally required to carry out certain identity and due diligence checks. These are commonly known as Anti-Money Laundering (AML) and Know Your Customer (KYC) checks.

This policy explains:

  • Why these checks are required
  • What information and documents we must obtain
  • How your information is verified and used

2. Legal and Regulatory Framework

Property Hub Ltd complies with the Money Laundering Regulations 2007 (and any subsequent amendments and successor regulations).

Property Hub Ltd is registered with HM Revenue & Customs (HMRC) for Anti-Money Laundering supervision.

  • HMRC AML Registration Number: XKML00000143895
  • Failure to complete AML and KYC checks may prevent us from acting on your behalf

3. Our Obligations

As a regulated estate agency and digital property platform, Property Hub Ltd must:

  • Verify the identity of all clients
  • Obtain proof of address
  • Establish property ownership or authority to act
  • Identify and verify beneficial owners
  • Understand the source and destination of funds where appropriate

Without satisfactory completion of these checks, we are legally prohibited from proceeding with instructions.

4. Proving Identity and Address (Individuals)

Required Documents

We require one document from List A and one document from List B.

Documents must be:

  • Original, or
  • Certified copies

Proof of address documents must be dated within the last 3 months.

List A – Proof of Identity (Photo ID)

  • Valid passport
  • UK or EEA driving licence

List B – Proof of Address

  • Utility bill
  • Mortgage statement
  • Bank or building society statement
  • Home or motor insurance certificate
  • Current local authority tax bill or tenancy agreement
  • NHS medical card

5. Property Ownership Information (List C)

To confirm ownership or authority to market a property, we may request:

  • Utility bill for the property
  • EPC certificate
  • Land Registry title register

6. Estates (Deceased Owners)

If you are acting as a Personal Representative of an Estate, we require:

  • Grant of Probate (where a will exists), or
  • Letters of Administration (where no will exists)
  • Proof of identity and address (List A & B) for the executor(s) or administrator(s)

7. Limited Companies (UK)

If you are acting on behalf of a UK limited company, we require:

  • Certificate of Incorporation
  • Articles of Association
  • Memorandum of Association
  • Latest Annual Return or Confirmation Statement showing current officers
  • Proof of identity and address (List A & B) for all individuals or entities holding 25% or more of the shares or voting rights

Where applicable:

  • Nominee director declaration
  • General Power of Attorney

8. Offshore Companies

If you are acting on behalf of an offshore company, we require:

  • Certificate of Incorporation
  • Articles and Memorandum of Association
  • Latest Annual Return or equivalent
  • Share certificates showing the Ultimate Beneficial Owner (UBO) or Certificate of Incumbency

Where shares are owned by another company, the above requirements apply to the holding company.

Additional requirements may include:

  • Nominee director declaration
  • General Power of Attorney
  • Proof of identity and address (List A & B) for all individuals or entities holding 25% or more ownership or control

9. Trusts

If you are acting on behalf of a Trust, we require:

  • Trust Deed
  • List of trustees
  • List of beneficiaries
  • Proof of identity and address (List A & B) for all individuals with:
    1. A vested interest of 25% or more of the trust capital, and/or
    2. Control over the trust

10. Electronic Identity Verification

In line with the Money Laundering Regulations, Property Hub Ltd may use electronic verification systems instead of, or in addition to, traditional documentation.

Where applicable:

  • Identity verification searches may be carried out using Experian
  • This is not a credit check and will not affect your credit score
  • Experian may check your details against public and private databases
  • A record of the search will be retained for compliance purposes

By instructing Property Hub Ltd, you consent to these verification checks where required.

11. Data Protection

All personal data collected for AML and KYC purposes is processed in accordance with:

  • UK GDPR
  • Data Protection Act 2018

Information is used strictly for compliance, verification and regulatory purposes and retained only for as long as legally required.

12. Failure to Provide Information

If you fail or refuse to provide the required information or documentation:

  • We may be unable to proceed with your instruction
  • We may be required to terminate our involvement
  • In certain circumstances, we may be required to make a report to the relevant authorities
